Book 18 Page 362 This Indenture made this 13th day of May in the year of our Lord one thousand seven hundred and Ninety four between Jackson Harwell of Lincoln County and State of North Carolina planter of the one part and John Lineberger of Lincoln County & State aforesaid planter of the other part witnefseth that for & in consideration of the Sum of Twenty five pounds goo & lawful money of the State aforesd.to the said Jackson Harwell in hand paid by the said John Lineberger ato or before the sealing & delivery - of these presents, the receipt & payment whereof he doth here =by acknowledge & thereof doth Re[]afe acquit & discharge the sd. John Lineberger his heirs Executors, Adms & afsigns by these presents he the said Jackson Harwell hath granted bargained & sold aliened & Confirmed and by these presents doth Grant bargain sell alien and confirm unto the said John Lineberger and his heirs & afsigns forever part of that Tract & mefsuage of Land Situate lying & being in the county of Lincoln, which Tract or Mefsuage of Same is Situate on the West Side of the Cataba river on the little Creek waters of Mountain Creek and is bounded as follows Beginning at the Spring branch on his own line running thence along the said line So. 44 Et. To a black oak his own corner thence with Lockmans line West 138. Poles to a poft oak Lock =mans comer thence Mooses line N.4.Es.56.poles to a pine said Mooses comer thence with sd. Line West 46. Poles to a black oak Saplin on Jas. Flemings line then down a Con -dition #line to the beginning including the Spring & branch containing Fifty acres more or lefs. Is the lower part of a Tract of Land granted to Jackson Harwell bearing & date the 26th day of Nov. 1793. And all houfes build =ings, orchards, ways waters water courfes profits Com -modities hereditaments & appurtenances whatfoever to to the said premifes hereby granted or any part thereof belonging or in any wise appertaining the Reversion and reversions Remainder & Remainders rents Ifsues and profits thereof and all the Estate Right Title Interest ufe Trust property Claim & demand whatsoever of him the sd. Jackson Harwell of into the sd. Premifes and all Deeds Evidences & writings touching or in any wise Con =cerning the Same To have and To hold the Lands hereby- Page363 Conveyed and all & Singular the other premifes hereby bargained & sold and every part & parcel thereof with their & every part & parcel thereof with & every of thir appurtenances to the said John Lineberger his heirs & afsignss forever to the only proper ufe and behoof of him the said John Lineberger his heirs and afsigns forever And the said Jackson Harwell for himself his heirs Executors & amntrs Doth Covenant promife and grant to and with the said John Lineberger & his heirs & afsigns that the said Fifty acres of Land be the same more lefs herein above mentioned & defcribed in manner & form aforesd. and that the said permifes are now and Soforever Shall remain free and clear from all former and other Gifts Grants bargains Sales Dower & title of Dower Judgements titles Troubles Changes and incumbrances made done committed or Suffered by the sd.
